Attempted murder, robbery charges result in indictments
Two Big Spring men who allegedly participated in the armed robbery of a local store in June were among 13 people indicted during Tuesday's session of the Howard County Grand Jury.Eufemio Ortiz Jr., 21, and Sunday C. Luna, 26, both currently incarcerated in the Howard County Detention Center, were indicted on first-degree aggravated robbery charges for their alleged roles in the Aug. 22 stick-up of the Boost Mobile store on FM 700.District Attorney Hardy L. Wilkerson said Ortiz is accused of robbing the store at gunpoint and making off with approximately $2,000 in cash, plus other materials. He then left the scene in a vehicle allegedly driven by Luna.The pair were apprehended by Big Spring police later that day, Wilkerson said.If convicted, the duo faces a possible sentence of between 5 and 99 years or life in prison.Also indicted Tuesday was 28-year-old Joshua Aaron Kirby, who stands charged with attempted murder, two counts of retaliation and burglary of a building.Wilkerson said Kirby stands accused of threatening, then attempting, to kill his girlfriend, who was scheduled to testify against him in a criminal trial in Midland. On June 15, Kirby — who was armed with a handgun — and a friend drove to Big Spring to confront the victim. Before Kirby could follow through on his threats, however, the friend contacted local police and Kirby was arrested without incident, Wilkerson added.
