Child sexual assault trial postponed

The trial of a 33-year-old Big Spring man charged with four counts of aggravated sexual assault of a child which was expected to get under way Tuesday in 118th District Court has been postponed, according to court officials.

Hector Manuel Gonzales Jr., of 3730 Adams St., was indicted by a Howard County grand jury in mid-April on four counts of aggravated sexual assault of a child, all first-degree felonies.

According to officials with the District Attorney's Office, the trial has been postponed to Dec. 3 because Gonzales' counsel — local attorney Don Richard — fell ill.

Jury selection in the trial began Monday, however, according to Assistant District Attorney Robin Orr, the jury panel is being dismissed.
“In a situation like this, a whole new jury panel will have to be called prior to the Dec. 3 trial,” Orr said.

The April indictment contends all four incidents of assault took place in 2010 with the first occurring March 1 and the last happening on or about Nov. 24.

The case was investigated by the Big Spring Police Department.

If convicted, Gonzales could face up to five to 99 years to life in prison for each count, as well as a fine not to exceed $10,000.

Gonzales remained in the custody of the Howard County Detention Center at the time of this report, with bond set at $50,000 per charge for a total of $200,000.
