Two indicted on multiple counts here
Friday, 18 December 2009

Two Big Spring men were indicted Wednesday on charges stemming from their Nov. 18 standoff with local law enforcement officers that caused a Howard County Sheriff's Deputy to sustain minor injuries.

Miguel Enrique Juarez, 21, currently in the Howard County Jail, was indicted on charges of unauthorized use of a motor vehicle (state jail felony), aggravated assault against a public servant (first-degree felony) and assault against a public servant (third-degree felony).

Also indicted as a result of the incident was Joe Luis Rodriquez, 17, currently in the Howard County Jail, on charges of unauthorized use of a motor vehicle (state jail felony) and aggravated assault against a public servant (first-degree felony).

Both men were arrested after allegedly stealing a pickup from the parking lot of a local bar, according to Sheriff Stan Parker.

“Sheriff’s office dispatch received a call concerning several vehicle burglaries at the Out Yonder Bar,” said Parker following the incident. “It was reported the suspects were leaving the scene in a gold Chevrolet pickup, traveling eastbound on Interstate Highway 20.

“While searching for the vehicle, dispatch received a call that a vehicle had struck a mail box, phone junction box and dumpster out on W. Robinson Road. Deputies with the HCSO and officers with the Big Spring Police Department arrived and found a gold Chevrolet truck attempting to leave the scene after striking the objects.”

Parker said what happened next turned what should have been a routine arrest for deputies and officers into an extremely dangerous situation for everyone involved.

“The vehicle was stuck as officers and deputies approached, identifying themselves as peace officers,” said Parker. “The driver attempted to flee. As law enforcement officers attempted to remove the occupants from the vehicle, the driver accelerated attempting to free the vehicle and placing officers in danger.

“Officers were forced to break the driver’s side window, forcefully removing the driver from the vehicle before anyone was seriously harmed. The passenger in the vehicle was ordered out of the vehicle and he exited armed with a knife. Officers struggled with the subject and disarmed him.”

Parker said officers quickly learned the pickup had been stolen from the Out Yonder Bar parking lot and property from five different vehicle burglaries was found in the cab of the truck.

No major injuries were reported as a result of the altercation, although one peace officer suffered minor cuts to his arms. The cuts did not require medical attention, according to Parker.

If found guilty, Juarez faces six months to two years in prison for the charge of unauthorized use of a motor vehicle, five years to 99 years to life in prison on the charge of aggravated assault against a public servant and two to 10 years in prison on the charge of assault against a public servant.
